What the terms actually say

Section 10.a — Arbitration

you agree that disputes arising under this EULA will be resolved by binding, individual arbitration

You are forced to resolve legal disputes through private arbitration rather than in a court of law.

Section 6.b — User Content License

you hereby grant to TuneIn... an unrestricted, perpetual, assignable, sublicensable, revocable, royalty-free right and license throughout the world to Use all User Content

TuneIn claims a permanent, global right to use, modify, and share anything you post, which survives account termination.

Section 14.b — Termination

TuneIn may further terminate this EULA immediately for any other reason with or without notice to you

TuneIn can delete your account and access to your content at any time for any reason without telling you first.

Section 13 — Indemnification

you agree to indemnify and hold TuneIn... harmless from and against any claims, liabilities, damages, losses, and expenses, including, without limitation, reasonable legal and accounting fees

You are financially responsible for TuneIn's legal costs if they are sued due to your use of the service.

Section 11.d — Liability Cap

TUNEIN’S LIABILITY... IS LIMITED TO THE GREATER OF THE FEES YOU HAVE PAID US IN THE LAST 12 MONTHS AND U.S. $100.

If TuneIn causes you harm, the most you can recover is $100 or what you paid them in the last year.

Section 10.c — Arbitration Opt-Out

you may opt out of the provisions of this Section 10 within 30 days... by sending an electronic mail to TuneIn Inc. at [email protected]

You have a 30-day window to opt out of the forced arbitration clause by emailing the company.
