What the terms actually say

Section 7.4 — Arbitration and Waiver

YOU AND KAYAK HEREBY WAIVE ANY CONSTITUTIONAL AND STATUTORY RIGHTS TO SUE IN COURT AND HAVE A TRIAL IN FRONT OF A JUDGE OR A JURY. ... YOU WILL ONLY BE PERMITTED TO PURSUE DISPUTES OR CLAIMS AND SEEK RELIEF AGAINST US THROUGH BINDING, FINAL ARBITRATION

You are prohibited from taking the company to court and must use private arbitration instead.

Section 6.2 — Your Content

If you post a review or any other content on KAYAK ("User Content"), you grant us a worldwide, royalty-free, perpetual, irrevocable, transferable, sub-licensable license to host, use, display, reproduce, modify, distribute and create derivative works from your User Content

The company gains a permanent right to use anything you post, which you cannot take back.

Section 7.2 — Limitation of Liability

To the maximum extent permitted by law, the total aggregate liability of KAYAK ... to you for all claims ... will not exceed one hundred U.S. dollars (US$100).

The company limits its financial responsibility to you to a maximum of $100.

Section 11 — A Few More Things

In any legal action ... the prevailing party will be entitled to recover from the other party its reasonable attorneys' fees and costs

This is a 'loser pays' provision that could make legal challenges very expensive for you.

Section 8.1 — How We Use Your Data

Neither KAYAK nor any third party LLM provider will use your Inputs, Outputs, or any personally identifiable or sensitive information to train LLMs.

The company promises not to use your personal data or AI inputs to train their AI models.

You can delete your account in your account settings.
