What the terms actually say

Section 2.2

Synacor may modify or update the Software at any time, for any reason, and without providing notice of such modification or update to You.

Synacor reserves the right to change the software at any time without notifying you.

Section 9.1

IN NO EVENT WILL SYNACOR AND/OR ITS AFFILIATES BE LIABLE FOR ANY ... LOSS OF DATA ... OR ANY OTHER INDIRECT, SPECIAL, INCIDENTAL, OR CONSEQUENTIAL DAMAGES.

Synacor disclaims all liability for data loss or indirect damages.

Section 12.8

YOU WAVE, TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, ANY RIGHT YOU MAY HAVE TO TRIAL BY JURY IN ANY LEGAL PROCEEDING DIRECTLY OR INDIRECTLY ARISING OUT OF OR RELATING TO THIS EULA.

You waive your right to a jury trial for any disputes related to this agreement.

Section 9.2

YOU MAY NOT BRING A CLAIM UNDER THIS EULA MORE THAN TWELVE (12) MONTHS AFTER THE CAUSE OF ACTION ARISES.

You must bring any legal claims within one year, which is shorter than many statutory limits.

Section 8.4

You agree to indemnify and hold Synacor free and harmless from any such liability, and from all loss, claims, costs, demands, debts, and causes of action in connection therewith, including reasonable expenses and attorneys’ fees.

You are required to pay for Synacor's legal defense and damages if they are sued due to your use of the software.
