USE OF SERVICES

In its sole discretion, in addition to any other rights or remedies available to the Company and without any liability whatsoever, at any time and without notice may terminate or restrict your access to any component of obsidian.md.

The company can ban you or shut down your access to the service whenever they want, for any reason, without telling you first.

LIMITATIONS OF LIABILITY

IN NO EVENT WILL THE COMPANY’S OR ITS SUPPLIERS’ TOTAL LIABILITY EXCEED IN AGGREGATE THE AMOUNT ACTUALLY PAID OR PAYABLE BY CUSTOMER TO THE COMPANY FOR THE SERVICES IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM. The company limits its financial liability to what you paid them in the last year, though they carve out exceptions for fraud or personal injury.

FEES AND PAYMENT

All fees are non-cancellable and non-refundable and are based on Services purchased and not actual usage.

All sales are final; you cannot get a refund for any reason, including unused service.

GOVERNING LAW

No cause of action arising hereunder or relating hereto may be brought more than one (1) year after it first accrues.

You must file any legal claim against the company within one year, or you lose the right to sue.

ACCEPTANCE

The Company may modify, supplement or amend these Terms and Conditions. If you have an account with us, you will be notified by email and given an opportunity to accept the changes.

The company promises to email you if they change the terms, giving you a chance to review them.
