What the terms actually say

Section 3.1 — Changes to the Terms

The Site reserves the right to amend these Terms and Conditions at any time and without notice, and it is Your responsibility to review these Terms and Conditions for any changes.

The company reserves the right to modify the agreement without providing any notice to the user.

Section 26.1 — Binding Arbitration

If the parties are unable to resolve the dispute through direct negotiations, then, except as otherwise provided herein, either party must submit the issue to binding arbitration.

Users are prohibited from seeking redress in court and must use private arbitration.

Section 26.2 — Class Action Waiver

The Arbitrator shall have no authority to award any punitive or exemplary damages, certify a class action, add any parties, or vary or ignore the provisions of this Agreement.

Users waive the right to participate in class action litigation.

Section 18.2 — Liquidated Damages

For any breach of a portion of this Agreement that does not specifically state a liquidated damages amount, You hereby agree that any breach of this Agreement shall result in liquidated damages of one hundred dollars ($100) per occurrence.

The company imposes a mandatory $100 penalty for any violation of the terms.

Section 26.4 — Statute of Limitations

No action... may be brought by any party more than one (1) year after the cause of action arose.

The time limit to file a legal claim is restricted to one year.
