What the terms actually say

Section 3.3 — Dispute Resolution

YOU AND RAKUTEN HEREBY WAIVE ANY RIGHT TO A JURY TRIAL OF ANY CLAIM.

You are giving up your constitutional right to have a jury decide your legal disputes with the company.

Section 3.9 — Class Action Waiver

Neither you nor Rakuten may act as a class representative or private attorney general, nor participate as a member of a class of claimants... You may not bring Claims in arbitration on a class or representative basis.

You are prohibited from joining other users in a class action lawsuit, forcing you to pursue claims individually.

Section 14.1 — Feedback License

You hereby grant to Rakuten... a nonexclusive, royalty-free, perpetual, irrevocable and fully sublicensable right to use... the Feedback in any media and for any legal purpose.

Any suggestions or feedback you provide become the company's property forever, to use however they want without paying you.

Section 1.1 — Modifications

Rakuten may at its discretion modify... these Terms and Conditions at any time. Each such modification will take immediate effect upon notification to you.

The company can change the rules of your agreement at any time, and those changes apply as soon as they post a notice.

Section 20.1 — Termination

We may terminate this Agreement, your Account, and your use of or access to the Services at any time, for any reason or no reason.

The company reserves the right to ban you from the service whenever they want, without needing a specific justification.

Section 3.13 — Arbitration Opt-Out

You may decline or opt out of this agreement to arbitrate by sending written and signed notice... within thirty (30) calendar days.

You have a limited window to opt out of the mandatory arbitration clause by mailing a physical letter.

Section 20.1 — Account Termination

You may terminate your Account by accessing your Account’s Privacy Preferences.

You can close your account yourself through the settings menu without needing to contact support.
