What the terms actually say

Section 2 — Your Use of Content

You hereby grant, transfer and assign to Ookla... a fully-paid, royalty-free, irrevocable, perpetual, worldwide right and license to publish, distribute, reproduce, transmit, use, translate, display, perform, modify, revise, create derivative works of and archive the Material...

You grant Ookla a permanent, irrevocable license to use, modify, and distribute anything you post, without needing to pay you or ask for permission.

Section 13 — Dispute Resolution

Any arbitration under this Agreement will take place on an individual basis; class arbitrations and class actions are not permitted.

You are forced into individual arbitration and waive your right to participate in any class action lawsuit.

Section 1 — General

We reserve the right, in our discretion, to change or modify all or any part of the Agreement at any time, effective immediately upon notice published on this page.

Ookla can change these terms at any time without notifying you via email or in-app alert; you are expected to check this page periodically.

Section 9 — Limitation of Liability

IF, NOTWITHSTANDING THE OTHER PROVISIONS OF THIS AGREEMENT, OOKLA IS FOUND TO BE LIABLE TO YOU FOR ANY DAMAGE OR LOSS... LIABILITY OF OOKLA SHALL IN NO EVENT EXCEED... ONE HUNDRED U.S. DOLLARS ($100.00).

Even if Ookla is found liable for damages, your recovery is strictly capped at $100.

Section 15 — Limitation Period for Claims

You agree that regardless of any statute or law to the contrary, any claim or cause of action... must be filed within one (1) year after such claim or cause of action arose or be forever barred.

You must bring any legal claim within one year, which is significantly shorter than most statutory limits.

Section 7 — Termination of Services

Conversely, you may terminate your access to the Services at any time by immediately ceasing use of the Services.

You have the right to stop using the service at any time.
