What the terms actually say

Section 6 — Modifications

Provider may, in its sole discretion, modify or replace this TOS at any time. End-User’s continued use of the Services following a change to this TOS shall constitute acceptance of such changes.

The company can change the rules at any time, and by continuing to use the service, you automatically agree to the new terms without receiving any notice.

Section 7 — Liability

IN NO EVENT SHALL PROVIDER BE LIABLE ... FOR ANY LOST PROFITS OR SPECIAL, INDIRECT, INCIDENTAL, PUNITIVE, OR CONSEQUENTIAL DAMAGES OF ANY KIND WHATSOEVER

The provider disclaims all liability for any damages or losses resulting from your use of the service.

Section 8 — Governing Law

This TOS shall be governed by and construed in accordance with the laws of the State of California

Any legal disputes must be resolved under California law.
