Section 13(b) — Dispute Resolution

ANY SUCH ARBITRATION SHALL BE CONDUCTED BY THE PARTIES IN THEIR INDIVIDUAL CAPACITIES ONLY AND NOT AS A CLASS ACTION OR OTHER REPRESENTATIVE ACTION, AND THE PARTIES WAIVE THEIR RIGHT TO FILE A CLASS ACTION OR SEEK RELIEF ON A CLASS BASIS.

You are prohibited from joining a class action lawsuit and must resolve all disputes individually through arbitration.

Section 4(B) — User Content License

you grant Nintendo a worldwide, royalty-free, irrevocable, perpetual, non-exclusive, and sublicenseable license to use, reproduce, modify, adapt, publish, translate, distribute, perform, and display such User Content

Nintendo takes a permanent, irrevocable license to use anything you post, which survives even if you delete your account.

Section 10 — Modifying/Terminating Services

You agree that we can suspend or terminate your right to access our Services at any time for any reason without notice, obligation or liability to you.

Nintendo can terminate your access to their services at any time, for any reason, without giving you any notice.

Section 15 — Changes to These Terms

We may change these Terms from time to time. If we do, we’ll provide notice of any changes, such as by posting the most recent version on our Services... Your continued use of the Services following any notice we provide will confirm that you have agreed to the amended Terms.

Nintendo can change the terms at any time; simply continuing to use the site constitutes your agreement to the new terms.

Section 5 — User Content and Interactive Areas

Nintendo reserves the right, and has absolute discretion, to access, use, monitor, disclose or preserve information associated with your use of the Services... when Nintendo forms a good faith belief that doing so is necessary (a) to comply with applicable law or to respond to legal process from competent authorities

Nintendo reserves the right to share your data with government or law enforcement agencies at their discretion.

Section 13(e) — 30-Day Right to Opt Out

You have the right to opt out of the provisions of this Section 13 by sending written notice of your decision to opt out to the following address... within 30 days of the start of your use of the Services.

You can opt out of the forced arbitration clause by mailing a physical letter to Nintendo within 30 days of starting to use the service.
