What the terms actually say

Section 12 — Dispute Resolution

YOU AGREE THAT, BY ENTERING INTO THESE TERMS, YOU AND MUX ARE EACH WAIVING THE RIGHT TO A TRIAL BY JURY OR TO PARTICIPATE IN A CLASS ACTION, COLLECTIVE ACTION, PRIVATE ATTORNEY GENERAL ACTION, OR OTHER REPRESENTATIVE PROCEEDING OF ANY KIND.

You are legally barred from joining class action lawsuits or having a jury trial for any disputes with Mux.

Section 2.2 — Rights to Data

You grant us a non-exclusive, irrevocable, assignable, sublicensable (through multiple tiers), fully paid, royalty-free, worldwide right and license to copy, reproduce, modify, use, publicly perform, display, distribute, and create derivative works of the Customer Data...

Mux claims a permanent, worldwide right to use and modify your data for almost any purpose, which you cannot take back.

Section 10.2 — Liability Cap

IN NO EVENT WILL OUR AGGREGATE LIABILITY ARISING UNDER THESE TERMS... EXCEED THE AMOUNTS ACTUALLY PAID BY YOU IN THE THREE MONTHS PRECEDING THE EVENT GIVING RISE TO LIABILITY.

Mux limits its financial responsibility to you to a maximum of three months of fees, regardless of the damage caused.

Section 12 — Dispute Resolution

no action, regardless of form, arising out of or relating to these Terms may be brought by either party more than one year after the cause of action has accrued

You must file any legal claim within one year, or you lose the right to sue forever.

Section 13.1 — Entire Agreement; Amendment

If we make any material changes to these Terms, we will use reasonable efforts to notify you of such changes (including in-app or via email).

Mux promises to try to inform you if they make significant changes to the agreement.
