What the terms actually say

Section 6 — McGraw Hill Use of Subscriber Data

McGraw Hill has the right to use the Personally Identifiable Information and Subscriber Data collected in connection with provision of the Solution for (a) purposes of performing its obligations under this Agreement, and (b) for research purposes in connection with quality control and the development of revised or new products or services

The company reserves the right to use your data for internal research and product development, provided it is aggregated.

Section 10 — Term and Termination

Subscriber may terminate this Agreement by (a) providing McGraw Hill with no less than thirty (30) days' prior written notice or (b) ceasing all access to the Solution for six (6) months or longer.

Cancellation is not a simple one-click process; it requires either 30 days' notice or six months of inactivity.

Section 14 — Liability

IN NO EVENT SHALL THE LIABILITY OF MCGRAW HILL OR ITS LICENSORS FOR WHATEVER CAUSE EXCEED THE FEES PAID BY YOU IN CONNECTION WITH YOUR USE OF THE MATERIALS

The company limits its financial liability to the amount you have paid them, which is standard but restrictive.

Section 15 — Indemnification

To the extent permitted by law, Subscriber shall indemnify, defend and hold harmless McGraw Hill and its parent, affiliates, successors and assigns

You are required to cover the company's legal costs if your use of the service leads to a third-party claim against them.

Section 4 — Applicable Privacy Law

McGraw Hill acknowledges that it will be considered a 'School Official' (as that term is used in FERPA) and agrees that it will comply with the requirements in FERPA concerning the confidentiality and release of Personally Identifiable Information.

The company explicitly commits to acting as a School Official under FERPA, which provides strong privacy protections for student data.
