What the terms actually say

Part II, Section 4.2 — Agreement to Arbitrate

You and eCI each agree that any and all disputes or claims... shall be resolved exclusively through final and binding arbitration, rather than in court.

You waive your right to sue in court and must use private arbitration instead.

Part II, Section 4.2.1 — Prohibition of Class Actions

YOU AND eCI AGREE THAT EACH OF US MAY BRING CLAIMS AGAINST THE OTHER ONLY ON AN INDIVIDUAL BASIS AND NOT AS A PLAINTIFF OR CLASS MEMBER in any purported class, or representative or private attorney general action or proceeding.

You are prohibited from participating in class action lawsuits against the company.

We’ll notify you before the changes take effect... at least 14 days in advance.

Part I, Section 10 — Your Right to Terminate

If your Payout Entity is not eBay Sarl or eCUK, you can terminate by closing your eBay account. If you continue to use Managed Payments afterward, you’ll be deemed to have accepted these terms again.

Cancellation is not a simple toggle; it requires closing your entire account, and continued use implies acceptance.
