Section 5 — Your Content

you hereby grant Datadog a perpetual, worldwide, nonexclusive, irrevocable, royalty-free, sublicensable (through multiple tiers) license to perform, display, reproduce, prepare derivative works from, distribute, sell, sublicense, transfer and otherwise use without restriction all or any part of such Content.

You grant Datadog a permanent, unrestricted license to use, sell, and sublicense any content you post on the site.

Section 18 — Modifications

Datadog may modify these Terms at any time by posting a revised version on the Site. By accessing the Site, you agree to the latest version of these Terms.

Datadog can change these terms whenever they want, and your continued use of the site constitutes your agreement to those changes.

Section 11 — Limitation of Liability

IN NO EVENT SHALL DATADOG’S CUMULATIVE AND AGGREGATE LIABILITY UNDER THESE TERMS EXCEED TWO HUNDRED U.S. DOLLARS.

Datadog limits its total financial liability to you to $200, regardless of the circumstances.

Section 16 — Termination and Monitoring

Datadog may report any activity that it suspects violates any law or regulation to appropriate law enforcement officials, regulators, or other appropriate third parties. Such reporting may include disclosing appropriate customer data.

Datadog reserves the right to share your data with law enforcement or regulators at their discretion.

Section 19 — Governing Law

Any legal action or proceeding arising under or relating to this Agreement shall be brought exclusively in the state or federal courts located in New York County, New York, USA

You must resolve all legal disputes in New York, regardless of where you live.
