What the terms actually say

Section 7.3 — Feedback

Customer grants to Buildkite a worldwide, royalty-free, fully paid, perpetual, irrevocable license to use, reproduce, modify, translate, reformat, distribute, perform, display, import, sell, license, offer for sale, make, have made and otherwise exploit the Feedback

Any suggestions or feedback you provide become Buildkite's property to use, sell, or modify forever without compensating you.

Section 11.5 — Updates to these Terms of Service

Buildkite may issue updated versions of these Terms of Service from time to time. ... The version of these Terms of Service in effect as of the Effective Date of an Order Form continues to govern that Order Form until it is renewed, at which point the then-current version of these Terms of Service applies

While existing orders are protected until renewal, new terms apply automatically upon renewal without explicit notice.

Section 9.1 — Limitation of Liability

IN NO EVENT SHALL EITHER PARTY'S TOTAL AGGREGATE LIABILITY ... EXCEED THE SUBSCRIPTION FEES ACTUALLY PAID BY CUSTOMER ... DURING THE TWELVE (12) MONTHS IMMEDIATELY PRECEDING THE DATE ON WHICH SUCH CLAIM ... AROSE.

Liability for both parties is capped at the total fees paid in the previous year.

Section 7.3 — Storage of Customer Content

Buildkite agrees only that it will not intentionally delete any Customer Content from the Buildkite Solution prior to termination of Customer’s applicable Subscription Term. ... Buildkite expressly disclaims all other obligations and liability with respect to storage and backup of Customer Content.

Buildkite does not guarantee data backups and disclaims liability for data loss.

Section 10.2 — Termination

Either party may terminate this Agreement if (i) the other party breaches this Agreement and fails to cure the breach within thirty (30) days

The contract provides a standard 30-day cure period for breaches before termination.
