What the terms actually say

Section 11(B)(ii) — Arbitration

we each agree to resolve any claim, dispute, or controversy... by binding arbitration by JAMS.

You are required to resolve disputes through private arbitration rather than in a court of law.

Section 3 — Content License

you grant us a worldwide, non-exclusive, royalty-free license... to use, host, store, copy, reproduce... including after termination of your use of the Products.

Blackboard retains a permanent right to use your content even after you stop using the service.

Section 4(C) — Unilateral Changes

We may, without prior notice, change any Product... at our sole discretion at any time without prior notice to you.

The company can modify or remove features of the service without warning.

Section 10(D) — Liability Cap

IN NO EVENT SHALL THE AGGREGATE LIABILITY OF THE BLACKBOARD ENTITIES EXCEED THE GREATER OF ONE HUNDRED U.S. DOLLARS (U.S. $100.00) OR THE AMOUNT YOU PAID BLACKBOARD.

The company limits its financial responsibility to you to a maximum of $100.

Section 9 — Account Deletion

If you wish to delete your Blackboard Product account(s) in their entirety(ies), you may contact us via [email protected] and specify which Blackboard Product account(s) you wish to delete. We will delete your specified accounts within a reasonable time.

You have a defined process to request the deletion of your account and data.
