What the terms actually say

Section 3 — Content License

you grant us a worldwide, non-exclusive, royalty-free license (with the right to sublicense) to use... (including after termination of your use of the Products)

Blackboard retains a permanent right to use your content even after you stop using the service.

Section 11(B)(ii) — Arbitration

we each agree to resolve any claim, dispute, or controversy... by binding arbitration by JAMS

You are required to resolve disputes through private arbitration rather than in a court of law.

Section 11(B)(iii) — Class Action/Jury Trial Waiver

YOU AND BLACKBOARD ARE EACH WAIVING THE RIGHT TO A TRIAL BY JURY OR TO PARTICIPATE IN A CLASS ACTION

You cannot join with other users to sue Blackboard, and you cannot have a jury hear your case.

Section 11(D) — Notice of Material Changes

If the revision, in our sole discretion, is material we will notify you through the Products or through the email associated with your profile.

For material changes to the Terms, Blackboard will notify you through the product or by email.
