What the terms actually say

Section 10.2 — Arbitration Agreement

All claims and disputes... that cannot be resolved informally or in small claims court shall be resolved by binding arbitration on an individual basis.

You are prohibited from taking the company to court for most disputes, and must use private arbitration instead.

Section 4 — User Content

You hereby grant to Company an irreversible, nonexclusive, royalty-free and fully paid, worldwide license to reproduce, distribute, publicly display and perform, prepare derivative works of...

You give the company a permanent, free, and global right to use, modify, and share anything you upload.

Section 10.2 — Waiver of Class or Consolidated Actions

All claims and disputes... must be arbitrated or litigated on an individual basis and not on a class basis.

You waive your right to participate in any class action lawsuit against the company.

Section 8 — Term and Termination

We may suspend or terminate your rights to use the Site at any time for any reason at our sole discretion.

The company can delete your account or block your access whenever they want, for any reason.

Section 10.2 — Waiver of Jury Trial

THE PARTIES HEREBY WAIVE THEIR CONSTITUTIONAL AND STATUTORY RIGHTS TO GO TO COURT AND HAVE A TRIAL IN FRONT OF A JUDGE OR A JURY.

You explicitly give up your right to a jury trial.

Section 9 — Limitation on Liability

notwithstanding anything to the contrary contained herein, our liability to you for any damages... will at all times be limited to a maximum of fifty U.S. dollars (u.s. $50).

The company's total financial liability to you is capped at $50, regardless of the harm caused.

Section 10.1 — General

Any changes to these Terms will be effective upon the earliest of thirty (30) calendar days following our dispatch of an e-mail notice to you or thirty (30) calendar days following our posting of notice of the changes on our Site. Continued use of our Site following notice of such changes shall indicate your acknowledgement.

The company provides 30 days' notice before changes to the terms take effect.
