What the terms actually say

Section 5.3.1 — Machine Learning and AI

We may use Customer Data to develop, support, and improve HubSpot AI features and functionality. We may also use Customer Data to train our AI models... You may opt out of having your Customer Data used for this purpose by updating your settings.

HubSpot uses your data to train AI models by default, but provides a clear, online mechanism to opt out.

Section 12.1 — Amendment; No Waiver

We will provide you notice of this revision by email or in-app notification. If you would like to receive an email notification when we update the Agreement, complete the form found at https://legal.hubspot.com/subscribe-tos-updates.

HubSpot commits to notifying users of changes and allows users to subscribe to email alerts for updates.

Section 9.1 — Customer Indemnification

You will indemnify, defend and hold us and our Affiliates harmless, at your expense, against any third-party claim...

You are required to cover HubSpot's legal costs and damages if they are sued due to your actions or use of the service.

Section 12.5 — Compliance with Laws

We reserve the right at all times to disclose any information as necessary to satisfy any law, regulation, legal process or governmental request.

HubSpot reserves the right to share your data with government entities at their discretion to comply with legal requests.

Section 4.1 — Term and Renewal

Except as specifically provided for in this Agreement, you may not cancel your subscription prior to the end of your Current Term, and we will not provide any refunds of prepaid fees.

Subscriptions are non-cancelable and non-refundable during the term, locking you into the contract.
