What the terms actually say

DPA 2.2 — Data Processing

EBSCO will not Process Customer Personal Data for any purpose, including for any commercial purpose, other than for the specific purpose of performing the services specified in the Agreement.

EBSCO commits to not using your data for commercial purposes or advertising.

DPA 2.8 — Data Processing

Upon termination of the Agreement, EBSCO shall, at Customer’s election, securely delete or return Customer Personal Data and destroy existing copies

You have the right to have your data deleted or returned upon contract termination.

DPA 3.3 — Joint Controller

EBSCO shall provide Customer’s end user Data Subjects with the ability to exercise their individual rights with respect to User Personal Data within a self-service portal.

Users have a self-service portal to manage their privacy rights and data.

I.3 — License

Licensee and Authorized Users may not use artificial intelligence tools or machine learning technologies with any of the content included in the Databases or Services for any purpose.

EBSCO explicitly prohibits the use of their content for AI or machine learning training.

II.2 — Limitation of Liability

THE MAXIMUM LIABILITY OF EBSCO... SHALL BE LIMITED TO THE TOTAL AMOUNT OF FEES RECEIVED BY EBSCO FROM LICENSEE HEREUNDER UP TO THE TIME THE CAUSE OF ACTION GIVING RISE TO SUCH LIABILITY OCCURRED.

Liability is capped at the amount paid by the customer, which is standard for B2B contracts.
