You will indemnify, defend, and hold Customer.io... harmless, including costs and reasonable attorneys’ fees, from any claim or demand made by any third party.
You are required to pay for the company's legal defense and any damages if they are sued due to your use of the service.
You may terminate your use of the Services... by providing written notice... please note that you will remain liable for all Fees for the remainder of the then-current Subscription Term.
Cancellation does not stop your payment obligations; you must pay for the full term even if you stop using the service.
CUSTOMER.IO’S LIABILITY UNDER THIS AGREEMENT WILL BE LIMITED TO THE GREATER OF: (A) THE AMOUNT PAID BY YOU... OR (B) $100.00 US DOLLARS.
The company limits its financial responsibility to you to a maximum of $100, regardless of the actual damages you suffer.
Customer.io may also terminate or suspend any and all Services immediately, without prior notice or liability, if you breach any of the terms.
The company reserves the right to shut down your account instantly without giving you a chance to fix the issue or receive prior warning.
Any dispute arising from or relating to the subject matter of this Agreement will be finally settled by the state and federal courts located in Multnomah County, Oregon.
You are forced to resolve all legal disputes in Oregon, regardless of where you are located.
