What the terms actually say

Section 11.2 — Liability Cap

BROWSERSTACK’S AND ITS SUPPLIERS’ ENTIRE LIABILITY TO CUSTOMER ARISING OUT OF OR RELATED TO THIS AGREEMENT... AT ANY TIME SHALL BE $1 UNDER THIS AGREEMENT.

The company limits its total financial liability to you to one dollar, regardless of the damages caused.

Section 8.1 — Fees & Payment

BrowserStack may change the fees in effect or add new fees and charges from time to time. Furthermore... at the time of any renewal... Customer agrees that BrowserStack may increase Customer’s recurring fees up to the greater of (i) the then list price... or (ii) eight percent (8%).

The company can change fees at any time and automatically increase your subscription price by 8% annually upon renewal.

Section 4.1 — Rights in Customer Content

Customer hereby grants to BrowserStack a non-exclusive, worldwide, royalty-free right to use, copy, store, transmit, modify, create derivative works of and display the Customer Content solely to the extent necessary to provide the Services to Customer.

You grant the company a broad license to modify and create derivative works of your content, though it is limited to providing the service.

Section 13.4 — Promotional Rights

Customer agrees that BrowserStack may refer to Customer’s name, trademarks, logos, Feedback, comments, suggestions, case studies, testimonials... in its marketing, advertising, customer references and website.

The company can use your brand assets and testimonials for their own marketing purposes without needing separate consent.

Section 12 — Confidential Information

The Receiving Party may make disclosures to the extent required by administrative or judicial process... provided the Receiving Party notifies the Disclosing Party in advance and cooperates in any effort to obtain confidential treatment.

The company commits to notifying you of government data requests, provided they are legally allowed to do so.
