What the terms actually say

Section 17.1 — Binding Arbitration

either party must submit the issue to binding arbitration in accordance with applicable Arbitration Ordinance.

You are prohibited from taking the company to court for most disputes, and must instead use private arbitration.

Section 1.4.2 — Liquidated Damages

if You fail to electronically sign this Agreement, You stipulate to and agree to pay Us two hundred and fifty dollars ($250.00) each time You access the Site as liquidated damages

The company attempts to charge you $250 per visit if you do not formally sign the agreement, which is an extreme and likely unenforceable penalty.

Section 1.7.1 — Unilateral Modifications

We reserve the right to do so, and You agree that We have this unilateral right. You agree that all modifications or changes to this Agreement are in force and enforceable immediately upon posting.

The company can change the terms of this contract at any time without giving you any notice.

Section 8.5 — Liability Cap

IN NO EVENT SHALL OUR MAXIMUM TOTAL AGGREGATE LIABILITY HEREUNDER FOR DIRECT DAMAGES EXCEED ... TEN DOLLARS ($10.00), WHICHEVER IS GREATER.

The company limits its total financial liability to you to a maximum of $10, regardless of the harm caused.

Section 9.7 — Broad Release of Claims

You hereby discharge, acquit, and otherwise release Company ... from any and all allegations, counts, charges, debts, causes of action, and claims relating in any way to the use of, or activities relating to the use of the Site

You are forced to waive your right to sue the company for almost any reason, including serious criminal or tortious conduct.

Section 18.1 — Statute of Limitations

YOU AND THE SITE AGREE THAT ANY CAUSE OF ACTION ARISING OUT OF OR RELATED TO THE SITE MUST COMMENCE WITHIN ONE (1) YEAR AFTER THE CAUSE OF ACTION ACCRUES.

You have only one year to bring a legal claim against the company, which is shorter than many standard statutory limits.
