Modification of these terms

We reserve the right, at our sole discretion, to change, modify, add, or remove portions of this Agreement at any time. Please check this Agreement and the iSpot Site periodically for changes. Changes will become effective immediately upon publication, but will not apply retroactively. Your continued

iSpot can change the terms at any time, with no email or in-app alert; new terms bind you the moment they are posted, and continued use counts as acceptance.

Prohibited Conduct (D.4)

User may not use the iSpot Site to aid in developing, training, re-training, fine-tuning, testing, improving, or enhancing products or services that use or incorporate generative artificial intelligence.

Users are forbidden from using the iSpot Site to build or train generative AI products. (This restricts users, not iSpot's use of user content.)

Termination

iSpot may terminate this Agreement immediately without notice if, in its sole judgment, you breach any of these terms or conditions. Upon termination, you must destroy all materials obtained from this site and all related documentation and all copies and installations.

iSpot can terminate your access immediately, without warning, at its sole discretion if it judges you violated any provision.

Termination (user self-serve)

You may terminate this Agreement by destroying all materials obtained from the iSpot Site and all related documentation and all copies and installations.

Users have a clear, self-serve way to terminate by destroying downloaded materials.

Limitation of Damages

IN NO EVENT WILL ISPOT OR ITS AFFILIATES, CONTRACTORS, EMPLOYEES, AGENTS, OR THIRD-PARTY PARTNERS, LICENSORS, OR SUPPLIERS TOTAL LIABILITY TO YOU FOR ALL DAMAGES, LOSSES, AND CAUSES OF ACTION ARISING OUT OF OR RELATING TO THIS AGREEMENT OR YOUR USE OF THE ISPOT SITE OR YOUR INTERACTION WITH OTHER ISPOT SITE USERS (WHETHER IN CONTRACT, TORT INCLUDING NEGLIGENCE, WARRANTY, OR OTHERWISE), EXCEED…

iSpot's total liability for all damages from any claim is capped at $1,000.

Indemnification

You agree to indemnify, defend and hold harmless iSpot and its affiliates, suppliers, licensors and partners from any claims, losses or liabilities arising out of or related to your use or access of the iSpot Site and/or any violation of this Agreement.

You must pay iSpot's legal costs and damages if a third party sues because of your use of the site or your breach of the agreement.

Governing Law and Jurisdiction

This Agreement will be governed by and construed in accordance with the laws of the State of Washington, without giving effect to any principles of conflicts of law.
