What the terms actually say

Section 1(A) — Modification

You agree that Epik may, in its sole and absolute discretion, modify this Agreement... and that such modifications are effective immediately upon posting to this Site.

The company can change the rules of the service at any time without notifying you, and you are bound by the new terms the moment they are posted.

Section 24 — Disputes

YOU UNDERSTAND, ACKNOWLEDGE AND AGREE THAT WE RESERVE THE SOLE AND ABSOLUTE RIGHT TO ARBITRATE ANY DISPUTE PRIOR TO OR IN LIEU OF OTHER TYPES OF DISPUTE RESOLUTION... waive your rights to a jury trial.

You are forced into binding arbitration at the company's discretion and waive your constitutional right to a jury trial.

Section 13(A) — Refunds

All prices and fees are non-refundable unless otherwise expressly noted, even if Services are suspended, terminated, or transferred prior to the end of the Services term.

All sales are final, and you will not receive a refund even if the company terminates your account or service.

Section 17 — Liability

IN NO EVENT SHALL EPIK... BE LIABLE TO YOU... FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, PUNITIVE, OR CONSEQUENTIAL DAMAGES... IN NO EVENT SHALL EPIK’S TOTAL AGGREGATE LIABILITY EXCEED THE TOTAL AMOUNT PAID BY YOU IN THE PREVIOUS ONE (1) YEAR.

The company severely limits its financial responsibility to you, capping potential damages at the amount you paid in the last year.

Section 10(A) — Government Disclosure

we reserve the right to access, preserve, and disclose to third parties any of your information or data (including personally identifiable information and private communications) related to a written complaint of infringement if we believe in our sole discretion that such access, preservation, or disclosure is necessary.

The company can share your private data and communications with third parties or authorities based on their own judgment.

Section 13(E) — Termination

This Agreement may be terminated: ... (ii) by us at any time and for any reason as determined in our sole and absolute discretion, without prior notice.

The company can terminate your account and access to your data at any time for any reason without giving you any notice.
