What the terms actually say

Part II, Section 4 — Agreement to Arbitrate

You and eCI each agree that any and all disputes or claims... shall be resolved exclusively through final and binding arbitration, rather than in court.

You cannot sue eBay in court; you must use private arbitration.

Part II, Section 4 — Prohibition of Class Actions

YOU AND eCI AGREE THAT EACH OF US MAY BRING CLAIMS AGAINST THE OTHER ONLY ON AN INDIVIDUAL BASIS AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS, OR REPRESENTATIVE OR PRIVATE ATTORNEY GENERAL ACTION OR PROCEEDING.

You are prohibited from joining class action lawsuits against eBay.

Part I, Section 5 — Indemnification

You are financially responsible for eBay's legal costs and losses if you breach the terms.

Part I, Section 8 — Collection of Owed Amounts

Unless you are a consumer in the EU or UK, you waive, to the extent possible under applicable law, any rights you may have to receive advance notice of any particular preauthorized charge.

eBay can charge your bank account without notifying you first.

Part I, Section 9 — Amendment

We’ll notify you before the changes take effect... at least 14 days in advance.
