Section 22 — Arbitration and Actions

any controversy, claim or dispute... will be referred to and finally settled (to the exclusion of the courts) by private and confidential binding arbitration... you agree to waive any right you may have to commence or participate in any class action

You are forced into private arbitration and waive your right to join class action lawsuits.

Schedule A — Submitter Content Submission Licence

you hereby irrevocably grant and assign to Digital Journal the unlimited right and licence... to publish, reproduce and otherwise use and exploit the User Content in any manner... you hereby waive in favour of Digital Journal and its assigns, all moral rights

You grant the company a perpetual, irrevocable, worldwide license to use your content for any purpose, and you waive your moral rights to it.

Section 9 — Modifications to Service

Digital Journal reserves the right... to modify these Terms and Conditions... with or without notice. You agree that any modification... may be effected without prior notice.

The company can change the terms at any time without notifying you.

Section 13 — Limitation of Liability

YOU EXPRESSLY UNDERSTAND AND AGREE THAT DIGITAL JOURNAL SHALL NOT BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR EXEMPLARY DAMAGES

The company disclaims all liability for any damages, including loss of data or profits.

Section 10 — Termination

Digital Journal, in its sole discretion, may suspend or terminate your use... for any reason... without prior notice.

The company can terminate your account and delete your content at any time for any reason without notice.
