What the terms actually say

Section 5.5 — Data Use

Customer authorizes and grants Contentsquare and its Affiliates a non-exclusive, perpetual, worldwide, royalty-free, right and license to (i) compile, access and use Customer Data... (iii) collect and use Usage Data for its business purposes, including... developing, training and improving its products and services.

Contentsquare reserves the right to use your data to train their machine learning models and improve their products.

Section 6.1 — Fees and Expenses

Once executed, Order Forms are non-cancellable and non-refundable except as expressly agreed in the relevant Order Form.

All purchases are final and non-refundable, preventing easy cancellation or termination for convenience.

Section 10.2 — Limitation of Liability

the total, cumulative liability of each Party... will be limited to the amounts paid by Customer for the CS Service during the twelve (12) month period preceding the first event giving rise to liability.

Liability is capped at the amount paid in the previous 12 months, which is a standard but restrictive limitation.

Section 5.5 — Data Use

In no event shall Contentsquare or its Affiliates sell Customer Data to third parties for any marketing or advertising purposes whatsoever.

Section 5.4d — Retention Period

Contentsquare shall delete or anonymize Visitor Data, by default no later than thirteen (13) months from its collection
