What the terms actually say

Section 11.2 — Binding Arbitration

YOU HEREBY ACKNOWLEDGE AND AGREE THAT BY AGREEING TO THESE TERMS AND ARBITRATION AGREEMENT, YOU AND BDG ARE EACH WAIVING THE RIGHT TO A TRIAL BY JURY TO THE MAXIMUM EXTENT PERMITTED BY LAW.

You are giving up your constitutional right to have a jury decide your legal disputes with the company.

Section 4.5 — License Grant

By submitting User Content through the Services, you hereby do and shall grant us a worldwide, non-exclusive, perpetual, royalty-free, fully paid, sublicensable and transferable license to use... User Content... including after your termination of your Account.

The company owns a permanent, transferable right to use anything you post, which continues even if you leave the platform.

Section 10 — Limitation of Liability

IN NO EVENT SHALL WE... BE LIABLE... (III) FOR ANY DIRECT DAMAGES IN EXCESS OF (IN THE AGGREGATE) $500.00.

The company limits its total financial responsibility to you to $500, regardless of the harm caused.

Section 5.4 — Disclosure

We also reserve the right to access, read, preserve, and disclose any information as we reasonably believe is necessary to (i) satisfy any applicable law, regulation, legal process or governmental request.

The company reserves the right to hand over your data to government agencies without explicitly requiring a warrant.

Section 3 — Registration

You shall have the ability to delete your Account, either directly or through a request made to one of our employees or affiliates.

You have a clear, accessible mechanism to delete your account.
