What the terms actually say

Section 1 — Introduction

These Terms require that if we get into a dispute with you relating to the Service (or vice versa), unless you live in the United Kingdom or the European Union, the dispute will be resolved by BINDING ARBITRATION. This means that YOU AGREE TO GIVE UP YOUR RIGHT TO GO TO COURT TO SUE US (OR BE SUED BY US) UNDER THIS CONTRACT

You must resolve disputes through binding arbitration, giving up your right to sue in court (with limited exceptions for UK/EU residents).

Section 16 — Limitation of Liability

OUR MAXIMUM AGGREGATE LIABILITY TO YOU FOR ANY AND ALL CLAIMS... IS LIMITED TO US$100.

If anything goes wrong, Unsplash's total liability to you is capped at just $100.

Section 10 — Termination of Your Account

we may terminate your account on the Service or suspend or terminate your access to the Service at any time (with or without notice) without liability to you.

Unsplash can close your account at any time, with or without notice, and without any liability to you.

Section 18 — Governing Law

our agreement under these Terms is governed by the laws of New York... you and we agree to the exclusive jurisdiction of the state and federal courts located in New York County, New York.

All disputes must be resolved in New York courts, regardless of where you live in the US or elsewhere.

Section 14 — Indemnity

You agree to defend and indemnify us, including our directors, officers, employees, consultants, affiliates, and agents, from and against any and all claims, liabilities, damages, losses, and expenses

You must pay for Unsplash's legal defense and any damages if a third party sues over your use of the service.

Section 18 — Dispute Resolution

YOU AND UNSPLASH ARE EACH WAIVING THE RIGHT TO A TRIAL BY JURY OR TO PARTICIPATE IN A CLASS ACTION LAWSUIT.

You explicitly waive the right to a jury trial, separate from the arbitration clause itself.

Section 10 — Termination of Your Account

You can terminate your account on the Service by going to https://unsplash.com/account/close.

Account closure is a single, free, self-serve web action — no phone call, mail, or fee required.

Section 12 — Modifying These Terms

We may, at times, make changes to these Terms on 7 days' notice. If and when we do, we will make reasonable efforts to notify you of the changes. We may provide these notices through a pop-up banner, by sending an email

Unsplash gives at least 7 days' notice before term changes take effect, via email or in-app banner.
